INTRODUCTION

These terms and conditions pertain to Calla Bleu (being the seller) and you (being the buyer). They apply to the use of this website and govern the formation of a contract between these two parties. By using this website, you acknowledge that you are bound by these terms. Calla Bleu may change the information on this website, including these terms and conditions, at any time. By continuing to use this website after any changes have been made, you acknowledge that you will continue to be bound by these terms.

Ordering goods from this website or by any other method constitutes an offer by you to buy in accordance with these terms and conditions. Calla Bleu's acceptance occurs and the contract is formed when the goods are dispatched to you. Any variations to these terms and conditions must be expressly agreed in writing by Calla Bleu. The contract including these terms and conditions of sale shall be governed by New Zealand Law.

PRICING

All pricing is checked at time of compilation, but subject to change without notice.  All prices are in New Zealand dollars and are inclusive of GST, unless otherwise stated.

Note that for international credit card orders, the price advertised may not be the same price charged to the credit card account due to exchange rate fluctuations.  This means that amount of your purchase is converted to New Zealand dollars at the exchange rate on the day it is processed.

INFORMATION ON THE WEBSITE

Modifications and improvements to the Calla Bleu’s products is an ongoing process.  Calla Bleu relies on information from its suppliers and product manufacturers.  Descriptions, illustrations and literature are therefore not binding on Calla Bleu.

Calla Bleu will make every effort to ensure product descriptions and pricing are accurate and up-to-date.  However, Calla Bleu reserves the right to adjust the price charged if the prices shown are incorrect, and to vary its pricing and product descriptions at any time without notice.

If the goods do not match the description on this website, you should inform us immediately so that we may take appropriate action.  The information provided by this website is subject to change without notice.  While every effort has been made to ensure its accuracy, Calla Bleu will not be liable for any inaccuracies in the information contained herein, except where provided for by the Consumer Guarantees Act 1993.  Calla Bleu will not provide support for product information which you locate via links to external sites.

CONSUMER GUARANTEES ACT 1993

If the goods are acquired for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 are excluded in relation to the goods.  If the goods are acquired for purposes other than a business, the provisions of the Consumer Guarantees Act 1993 and these terms and conditions shall be interpreted subject to the purchaser's rights under the Act.

DELIVERY

Calla Bleu reserves the right to dispatch your order in one delivery or by a number of installments. You may cancel those installments that have failed to be delivered however can not rebut the contract as to any installments that have already been delivered.  Although we will provide estimated delivery times, these shall not be bound contractually.

For international orders, you must bear the cost of any importation duties, taxes and any related charges.

PROPERTY AND RISK

Risk, including insurance responsibility, shall pass to you upon delivery by us or by the delivery carrier to you.

SHORTAGES OF GOODS

In the unlikely event that you purchase an item through the website that Calla Bleu is unable to supply, you will be entitled to a full refund of your purchase.

DAMAGES OR LOSS IN TRANSIT

All goods leaving our premises are checked for damages and are adequately packed. It is anticipated you will receive your goods within ten working days and you must inform us if you have not received the goods within 12 working working days.  You must check that the items are in good condition within two business days of receiving the order and inform us if this is not the case. It is at our discretion whether claims will be considered after two business days of receipt of goods.

CALLA BLEU’S LIABILITY

You need to ensure that the goods ordered are fit and suitable for the purpose for which they are required.

All New Zealand manufacturers' guarantees are fully valid on products we sell. You are only entitled to such benefits as we may receive under any guarantee given to us by the manufacturer of the goods.

Calla Bleu’s liability under this contract is confined to the entity purchasing the product. The buyer's rights under the contract are not transferable without our prior written consent.

ERRORS OR OMISSIONS

Calla Bleu is entitled at any time to correct all errors and omissions in any advertising, quotation, invoice or acknowledgement. If errors and omissions are discovered that, in our opinion materially affect the performance of the goods, we will notify you and give you the option of returning the goods for a refund or credit.

INTELLECTUAL PROPERTY RIGHTS

We hold all copyright and other intellectual property rights on this website. You may not use the information on this website and reproduce it (electronically or in hard copy) in any way.

PRIVACY POLICY AND SECURITY

We collect information for the purposes of fulfilling your order and processing your payment. This information includes your name, billing address, shipping address, phone number and email address. We do not share this information and will not make your details available to any third parties. If you provide us with your credit card details they will remain private and confidential and will not be disclosed to any third parties.

From time to time we may send you product information (including special offers) in the mail or by email. If at any time in the future you wish to remove your name from our customer list, you need only ask.

PAYMENT DETAILS

For all purchases made electronically, the name that will appear on your statement will be Calla Bleu NZ.

PAYMENT AND DEBT RECOVERY

We require payment before we begin your engraving as this is a non reversible process and we cannot restock or return engraved items.

Should your payment be dishonoured, cheque bounce, be withdrawn, or otherwise become unavailable to us, we reserve the right to collect your debt through an external agency and pass the cost of collection on to you.  In the event of default of payment when due, all costs of collection, including legal fees and court costs, shall be paid by you, the client.

Any credit extended to you may be reduced or eliminated in the event Calla Bleu, in its reasonable discretion, determines that your financial situation or ability to pay is impaired.

Calla Bleu reserves the right to transfer your debt to any party we deem necessary to aid in the pursuit of your debt.

You guarantee to make good any overdue charges owed to Calla Bleu in the event of you are placed in receivership, cease trading or are wound up.

In the event of going into receivership, being wound up, ceasing trading, or non-payment you agree to be individually and personally liable and to honour any outstanding debts and costs.
